San Francisco — The following complaint has been filed against the city of Berkeley, California on behalf of the American Civil Liberties Union of Northern California and Berkeleyside, an online publication, in response to the city’s assertion that Berkeley Police Department records related to police misconduct predating January 1, 2019 are exempt from disclosure, despite the passage of the historic police transparency bill, S.B. 1421. The ACLU of Northern California asks that the city release all the records requested in its possession, regardless of when they were created, allowing it to withhold only those portions that the current law protects from disclosure.
