Know Your Rights: U.S. Airports and Ports of Entry

Now more than ever, it's important to know your basic constitutional rights when entering the United States from abroad. The Constitution prohibits U.S. Customs and Border Patrol (CBP) agents from performing stops, searches, detentions, or removals based solely on religion, race, national origin, gender, ethnicity, or political beliefs.

ALERT: Certain noncitizens should consider the risks of flying, including on domestic flights within the US. These include — but are not limited to — people who lack authorization to be in the US, people with final orders of removal, people with temporary or discretionary status such as DACA, parole, or TPS, people with an expired visa or pending applications, and people with any prior criminal arrests. ICE is using flight passenger information to locate noncitizens and arrest them when boarding or after disembarking from flights. For additional information about the categories of noncitizens who appear to be at greater risk, see below. Noncitizens who feel uncertain regarding their own risks should consult an attorney, if able to do so.
