Barrett v. Rosenthal (Internet Free Speech Victory)

The issue raised in Barrett v. Rosenthal was whether the protection of the Communications Decency Act's Section 230 applies to individuals who frequently use the Internet to pass on information obtained elsewhere, whether by forwarding an email written by someone else or, as was the case in Barrett, posting an email from someone else to a newsgroup. The ACLU Foundation of Northern California filed an amicus brief in the California Court of Appeal arguing that Section 230 means what it says and applies to “users” of interactive computer services as well as “providers.”

Evans v. City of Berkeley

After the City terminated the Sea Scouts' free berth space, the Sea Scouts sued the City, claiming that it had violated their First Amendment and equal protection rights. The trial court dismissed the action, and plaintiffs appealed. The First Appellate district affirmed. Evans v. City of Berkeley, 104 Cal. App. 4th 1 (2002). The appellate court (after affirming the dismissal of contract and other common-law claims) held that the City did not violate the plaintiffs' First Amendment or equal protection rights.
